1. Contract For Sale

A legally binding contract between us will only occur after you receive from us a confirmation email of your order at the email address provided in your order and we have received full payment by you for the total amount of goods ordered.

2. Delivery

Delivery of goods will be to the shipping address provided in your order, or if none, to the billing address you supply.
We currently ship t0 the U.K. and Republic of Ireland, E.U., U.S.A and Canada, other International destinations as specified in our Customer Services page.

a) For U.K. and Republic of Ireland delivery, a charge of £4.99 will be added to your order.
(There is free delivery on all U.K. orders above £100)

b) For E.U. delivery an extra charge of £7.50 will be added to your order.

c) For U.S.A. and Canada delivery, an extra charge of £9.99 will be added to your order.

c) For the Rest of the World, an extra charge of £12.50 will be added to your order

Once payment has cleared, your products will be dispatched. For U.K. delivery, the products will arrive the next working day. For International Delivery, the products will arrive within 2-7 days.

For products which are out of stock, the delivery time will vary between 2-3 weeks.
We will use our reasonable endeavour to deliver the products within the times indicated. However, we will not be held liable for late delivery of products caused by circumstances beyond our reasonable control.
If nobody is available to collect the products when they are delivered, you are responsible for the rapid collection of the products. It is important that the addresses supplied by you to us are accurate.

3. Order Cancellation

a) If you wish to cancel your order, you must notify us as quickly as possible at [email protected] or at the telephone number provided on our website before the order is dispatched. In that case, a full refund will be given as soon as possible. In the event that the order is dispatched, please refer to “Return Policy”.
b) In the event that items you order are out of stock, or an error in the price of the items has occurred we will notify you by the email address or telephone number you have provided in your order. If we are not able to contact you, the part of your order which is out of stock or has a price error will be cancelled, and the equivalent amount will be refunded to you as soon as possible.

4. Return and Exchange Policy

Products purchased from our website may be returned to us or exchanged within 14 days of delivery to you, provided that they are returned to us unused and in their original condition. The products should be returned to us and insured by Royal Mail Special Delivery for orders within the U.K and by an insured courier for orders outside of the U.K. For hygiene reasons, earrings cannot be returned.
Should you receive a damaged or defective item, or an item which you have not ordered, you must notify us within 14 days and we will compensate for any shortage, replace or repair any products that are damaged or defective or refund you the full amount paid by you.
When returning items you are strongly recommended to obtain proof of posting. We are not responsible for parcels lost in transit.
A prompt refund of the price of the goods will be issued once they are returned in their original packaging with proof of purchase. The credit card used for the original purchase will be credited with the original price.
For all returns, except where the item is faulty or dispatched in error by us, you will be required to arrange and pay for the return of the products to us.

5. Products

All our products are unique and handcrafted and therefore there may be small variations in their size, shape and colour from their representation on our website.

6. Customs and Excise

When ordering products from Mishca London for delivery overseas you may be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for customs clearance must be paid by you; we have no control over these charges. Customs policies vary widely from country to country, so you should contact your local customs office for further information.

7. Copyright

All the contents of the website, including designs, images, photographs, logos, and written text are protected by copyright, trademark and other intellectual property rights owned, controlled or licensed to Mishca Jewellery Ltd. You may not publish, distribute, reproduce or make any commercial use of the content of the website.

8. Liability and Indemnity

Nothing in these terms and conditions excludes or limits liability for death or personal injury caused by negligence, fraudulent misrepresentation, or any other liability which may not otherwise be limited or excluded under applicable law. Except as set out above and in relation to our contractual obligations to supply products following acceptance of orders placed on our website, neither we nor any of our agents, affiliates, directors, employees or other representatives will be liable in contract, tort, negligence or otherwise for any loss or damage whatsoever in any way connected with your use or misuse of the website or customer services, or any other indirect or consequential loss arising out of or in connection with your use of the website or customer services (including without limitation, any such loss arising out of or in connection with any order placed on the website, whether or not accepted by us). We will take all reasonable precautions to keep the details of your order and payment secure, but, unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by you. Notwithstanding the above, subject to Mishca Jewellery Ltd’s aggregate liability (whether in contract, tort or otherwise) for loss or damage shall in any event be limited to a sum equal to the amount paid or payable by you for the product(s) in respect of one incident or series of incidents attributable to the same clause.

You agree to indemnify us and our agents and officers, directors and employees, immediately on demand, against all claims, liability, damages, costs and expenses, including legal fees, arising out of any breach of these Terms and Conditions by you. We may terminate your use of the website immediately if we consider that you have breached these Terms and Conditions.

9. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and you submit to the non-exclusive jurisdiction of the English courts.
